These Terms govern

the use of sajedhap.com and
any other related Agreement or legal relationship with the Owner

in a legally binding way. Capitalized words are defined in the relevant dedicated section of this document.

The User must read this document carefully.

Nothing in these Terms creates any relationship of employment, agency, or partnership between the involved parties.

this website, including its subdomains and any other website through which the Owner makes its Service available;

applications for mobile, tablet and other smart device systems;

the Application Program Interfaces (API);

any applications, sample and content files, source code, scripts, instruction sets or software included as part of the Service, as well as any related documentation;

WHAT USER SHOULD KNOW AT A GLANCE

Usage of sajedhap.com and the Service is age restricted, as detailed in the relevant section of this document.
Please note that some provisions in these Terms may only apply to certain categories of Users. In particular, certain provisions may only apply to Consumers or to those Users that do not qualify as Consumers. Such limitations are always explicitly mentioned within each affected clause. In the absence of any such mention, clauses apply to all Users.

TERMS AND CONDITIONS OF THE CLIENT

Important: Please read the terms and conditions that apply to Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) website and professional services. By accessing the site and making an appointment, you agree to the following terms and conditions. If you are unable or unwilling to agree to these terms and conditions, then you should not use or access the site, book an appointment or continue with your course of analysis/management.

REFUND, RESCHEDULING & CANCELLATION POLICIES:

Please Note: In very rare and extreme cases, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) may deal with penalty fees for rescheduling/cancellations that occur within the 72 hours of your booked online session on a case-by-case basis or in accordance with the rescheduling and cancellation policy timeframe mentioned in below points in this document. The aim is for you to be pleased with the service you receive. In such cases of an emergency, please immediately email Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) at: [email protected] and mark the subject line as “URGENT.” She will make every effort to amend and assist you with the situation. Otherwise, the penalty fees will apply, your appointment will be automatically cancelled, and you will have to go through a new booking process if you wish to continue.

Refund Policy

All sessions paid, whether attended or not, are non-refundable. This includes any package/plan that is booked and paid for entirely or partially in advance for a package/plan that involves a payment plan.

Session fees are for your commitment to yourself and Sam Marandi’s (RTT Practitioner and Professional Clinical Hypnotists) time and professional expertise and are not based on the guarantee of a successful outcome. Please refer to any appointments that fall in accordance with the rescheduling, cancellation and booking policy timeframe mentioned below in this document.

Rescheduling Policy

Hypno-Analysis appointments must be rescheduled 72 hours before the scheduled date and time, in which no fees will apply. However, any no-contact, no-shows, or rescheduling within the timeframes mentioned below is subject to an extra penalty fee.

Within 72 hrs of the scheduled online session will result in a 25% penalty fee.

For such purposes, by using this website, you acknowledge, agree and give full consent to Sam Marandi of Sajed H.A.P. to save your credit card number on file and apply any and all the agreed-upon penalty charges to your saved credit card number.

Also, your rescheduling MUST take place within 30 days from the last booked appointment. The rescheduling policy also applies when a package/plan is booked and paid for entirely or partially in advance for a package/plan that involves a payment plan. Note: If the appointment is not rescheduled within the 30-day timeframe from the last booked appointment, Sam Marandi of Sajed H.A.P. reserves the right to cancel that booking.

Cancellation policy

Hypno-Analysis appointments must be cancelled 72 hours before the scheduled date and time, in which no fees will apply.

However, any no-contact, no-shows, or rescheduling within the timeframes mentioned below is subject to an extra penalty fee.

Within 72 hrs of the scheduled online session will result in a 25% penalty fee.

BOOKING POLICY:

Booking Policy

Upon booking, full payment will be required. If you’ve chosen a payment plan for your package, you must make the first instalment upon booking your online session and make each consecutive payment every 25 days from your last payment and before your next booked appointment. You will be notified via email reminder 7 days prior, so you will have plenty of notice before payment is deducted from your nominated card.

Please Note: For payment plans where the second payments are not received by their due date, any booked session will be automatically cancelled and may be offered to someone else. You are responsible for paying the total session fees on time as scheduled. For more details on rescheduling and cancellation, please see the refund, rescheduling, and cancellation policy mentioned above in this document.

BOOKING CONDITIONS

Only people with sound mental health who are confident that a review of past events will not adversely impact their emotional or mental health should participate. Root Cause therapy is an approach to treatment that focuses on resolving significant past events believed to be interfering with a person’s present mental and emotional wellness. We request that you do not participate in any hypnoanalysis sessions if you or your treating practitioners have any past or existing concerns about your mental health.

Please note that Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will be unable to offer any professional services IF:

– Anyone that a review of past events will unfavourably impact your emotional or mental health should you partake in a session.
– If you or your treating practitioners have any past or existing concerns about your mental health – It is your responsibility to first check with the appropriate physician if you’re unsure.
– You have epilepsy or any form of psychosis, psychiatric disorders or personality disorders. This includes anyone with psychotic symptoms, such as hallucinations and delusions – It is your responsibility to check with the appropriate physician if you’re unsure.
– You’re inquiring about issues related to narcotic addictions, smoking, drinking, Infertility, IVF, Conception, Pregnancy, Birth, PTSD, and Sexual related problems.
– You’re diagnosed with clinical depression.
– You’re under the influence of alcohol or recreational drugs.
– You’re pregnant.
– You’re not considered an adult and are under 18.

Please Note: If you meet one of the above conditions and book and attend a session, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) reserves the right to cancel the session immediately, forfeit the full session fee and refuse to see you for any future sessions.

INTRODUCTORY ZOOM CALL

You can book a free 30-minute online introductory Zoom call. No therapeutic analysis/management will be provided during this call.

This initial call aims to discover and address any questions or concerns and see whether you and Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) are a good fit. During these calls, estimates of the number of sessions required to deal with your presenting issue may be given based on the information presented at the time of the call. Estimates are only rough guidelines and are subject to change at any time.

Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) may also be able to give you a fair assessment of how much improvement you can expect by the end of the initial free call, but please note that these are rough estimates as issues may be more complex. Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will jointly review progress from time to time, and progress can be reviewed continuously if you wish to do so.

ATTENDING SESSIONS

Please ensure that you are available at your session start time. If you are running late, please let Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.)] know as soon as possible via email at [email protected].

Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will do her best to make an entire session available. However, as the ability to do this will depend on bookings after your session, this cannot be guaranteed.

STANDARDS OF BEHAVIOUR

During any session, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will treat you professionally and respectfully and not abuse your trust in her. Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will always use best practices for your mutual interests. In return, you do not harm yourself or any other person, including Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.), or any property belonging to either Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) or any other person.

You agree not to attend sessions under the influence of alcohol or recreational drugs except those prescribed by your doctor.

Please Note: If you attend sessions under the influence of alcohol or recreational drugs and demonstrate violent or abusive behaviour, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) reserves the right to cancel the session immediately, forfeit the full session fee and refuse to see you for any future sessions.

MEDICAL CONDITION & HISTORY

Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) may ask questions about your medical history to establish any contra-indications to issue analysis/management/considerations. This will also help to assess whether your health is affecting (or being affected by) the goals you wish to achieve. Please update Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) on any medical changes during your therapeutic analysis or if you are returning after a period of absence.

Please Note: If you are receiving care or treatment from any medical, healthcare or therapy practitioner, e.g. GP, Psychologist, Psychiatrist or Counsellor, or any healthcare professional, you may be asked to seek their permission before any analysis/management sessions can commence with Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.).

OUTCOME OF SESSIONS

The agreement to work on the issues presented by you in no way implies or guarantees the resolution of your presenting problem(s). No outcome can or will be guaranteed.

Although Rapid Transformational Therapy (RTT) has an incredibly high success rate, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) cannot and does not guarantee results since your success depends on many factors that Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) has no control over, including your willingness and desire to participate in your healing process/journey that affects the changes inside of yourself. Hypnosis, analysis, and other associated approaches are not a “magic pill or a quick fix,” Those therapeutic considerations require you to be committed to your change.

Results cannot be guaranteed. Moreover, results from individual testimonials are for reference, and example purposes only, and your own personal experience may differ from those shown on this site.

You knowingly and voluntarily agree to waive and release Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) from any and all claims of liability or demands for compensation that you may acquire during your time working with Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.). If you’re unwilling to accept that, please do not book.

NUMBER OF SESSIONS

There are considerable variations in the difficulty of the various problems, and no general rule makes it possible to say how much improvement can be achieved. As a standard, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) sees clients for three sessions but will make adjustments depending if the issue is more complex or straightforward. Sam Marandi will discuss any changes with you in advance.

However, Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) will always endeavour to use her best efforts and skills to work with you towards your goals and intended outcomes but cannot guarantee the number of sessions required per each presenting issue.

CONTACT BETWEEN SESSIONS

Any contact between sessions will be via email during office hours, Monday to Friday, 9 a.m. to 5 p.m. PST. Any messages received outside these hours will be dealt with during office hours. Sam Marandi will do her best to get back to you no later than 48 hours.

RECORDINGS

Hypnotic recordings are made during or after your session. Audio recordings may include your voice. Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) retains full copyright over any forms of media that may be produced and distributed to you.

Please Note: You may be asked to listen to audio recordings, which will be provided after the session. These recordings are designed to help you gain the most benefit; not doing this will likely reduce your results’ effectiveness and solidification. For more details on rights granted and reserved, please refer to the point mentioned below in this document.

CONFIDENTIALITY & RETENTION OF INFORMATION

All contact, including online sessions, telephone conversations and emails, will be conducted in confidence and may be recorded. Before any recording, your agreement will be sought. All recordings, discussions, personal information and notes will remain confidential except in the following circumstances:

Where you permit confidentiality to be broken, for example: where a referring GP or other healthcare professional requires a report, a copy of the information will be available but on your request.
Where a court of law compels me.
Where the information is of a nature that confidentiality cannot be maintained, for example:

The possibility of harm to yourself or others exists
In cases of fraud or crime
When minors (under 18 years old) are involved

Please Note: All recordings, discussions, personal information and notes will remain confidential and kept for 6 months in a secure and private external drive from the time of your session, after which they will all be permanently deleted.

DISPUTE RESOLUTION

Amicable Dispute Resolution

Users may bring any disputes to the Owner who will try to resolve them amicably.

While Users’ right to take legal action shall always remain unaffected, in the event of any controversy regarding the use of sajedhap.com or the Service, Users are kindly asked to contact the Owner at the contact details provided in this document.

The User may submit the complaint including a brief description and if applicable, the details of the related order, purchase, or account, to the Owner’s email address specified in this document.

The Owner will process the complaint without undue delay and within 2 days of receiving it.

Procedure

A complaint can be received verbally or by email. Please contact us with full details of your dissatisfaction within 14 days at: [email protected] with the subject line: Complaint.

What will happen next?

A complete account of the complaint will be recorded.
Owner will send you a letter acknowledging receipt of your complaint within two working days of receiving it, enclosing a copy of this procedure.
Owner will then investigate your complaint within fourteen days. This will typically involve a thorough review of your complaint.
Owner will send you a detailed written reply to your complaint, confirming what took place and any solutions that have/were agreed upon with you.
At this stage, if you are still not satisfied, you should contact me again, and I will arrange to review the decision with my Programme Lead.
Owner will write to you again within 14 days of receiving your request for a review, confirming our final position on your complaint and explaining our reasons for the decision taken.

Online Dispute Resolution For Consumers

The European Commission has established an online platform for alternative dispute resolutions that facilitates an out-of-court method for solving disputes related to and stemming from online sale and service contracts.

As a result, any European Consumer or Consumer based in Norway, Iceland, or Liechtenstein can use such platform for resolving disputes stemming from contracts which have been entered into online. The platform is available at the following link.

If you have a concern or complaint regarding your online sessions, please discuss this with Sam Marandi of Sajed Hypno Analysis Practice (H.A.P.) in the first instance. She will endeavour to resolve the issue.

We are committed to providing a high-quality service to all our clients. When something goes wrong, we encourage you to tell us about it as soon as possible. Complaints provide us with an opportunity to learn and improve for the future, as well as a chance to put things right for you.

defaming, abusing, harassing, using threatening practices, threatening or violating the legal rights of others in any other way;
promoting activity that may endanger the User’s life or the life of any other User or lead to physical harm. This includes but is not limited to suicide threats or instigations, intentional physical trauma, the use of illegal drugs, or excessive drinking. Under no circumstance is any User allowed to post any content promoting and/or encouraging and/or showing any self-destructive or violent behaviour on sajedhap.com;
probing, scanning or testing the vulnerability of sajedhap.com, including the services or any network connected to the website, nor breaching the security or authentication measures on sajedhap.com, including the services or any network connected to sajedhap.com;
installing, embedding, uploading or otherwise incorporating any malware into or via sajedhap.com;
using sajedhap.com or the technical infrastructure in an abusive, excessive or otherwise inappropriate way (for example: for spamming purposes);

User protection

misappropriating any account in use by another User;
harvesting or collecting any personally identifying information of other Users including but not limited to their email addresses or contact information, by circumventing the privacy setting of other Users’ accounts on sajedhap.com or by any other means;
using any information relating to other Users, including personal or contact data, for purposes other than those sajedhap.com is intended for;

Commercial use restrictions

registering or using sajedhap.com in order to promote, sell or advertise products or services of any kind in any way;
indicating or trying to imply in any manner, that a User stands in a qualified relationship with sajedhap.com or that sajedhap.com has endorsed the User, the User’s products or services or any third party’s products and services for any purpose;

Software License

Any intellectual or industrial property rights, and any other exclusive rights on software or technical applications embedded in or related to sajedhap.com are held by the Owner and/or its licensors.

The Owner reserves the right to release updates, fixes and further developments of sajedhap.com and/or its related software and to provide them to Users for free. Users may need to download and install such updates to continue using sajedhap.com and/or its related software.

New releases may only be available against payment of a fee.

The User may download, install, use and run the software on unlimited devices.

However, it may not be permitted to run the software on more than one device at a time.

Indemnification

The User agrees to indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners and employees harmless from and against any claim or demand ⁠— including but not limited to lawyer’s fees and costs ⁠— made by any third party due to or in relation with any culpable use of or connection to the Service, violation of these Terms, infringement of any third-party rights or statutory provision by the User or its affiliates, officers, directors, agents, co-branders, partners and employees to the extent allowed by applicable law.

Limitation of Liability

Unless otherwise explicitly stated and without prejudice to applicable statutory product liability provisions, Users shall have no right to claim damages against the Owner (or any natural or legal person acting on its behalf).

This does not apply to damages to life, health or physical integrity, damages resulting from the breach of an essential contractual obligation such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as sajedhap.com has been appropriately and correctly used by the User.

Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, the Owner shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.

In particular, within the limits stated above, the Owner shall not be liable for:

any loss of business opportunities and any other loss, even indirect, that may be incurred by the User (such as, but not limited to, trading losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, etc.);

damages or losses resulting from interruptions or malfunctions of sajedhap.com due to acts of force majeure, or unforeseen and unforeseeable events and, in any case, independent of the will and beyond the control of the Owner, such as, but not limited to, failures or disruptions of telephone or electrical lines, the Internet and / or other means of transmission, unavailability of websites, strikes, natural disasters, viruses and cyber-attacks, interruptions in the delivery of products, third-party services or applications;

any losses that are not the direct consequence of a breach of the Terms by the Owner;

any damage, prejudice or loss occurring due to viruses or other malware contained in or connected to files available for download from the internet or via sajedhap.com. Users are responsible for implementing sufficient security measures – such as anti-viruses and firewalls to prevent any such infection or attack and for securing backup copies of all data or information exchanged via or uploaded to sajedhap.com.

Notwithstanding the above, the following limitation applies to all Users not qualifying as Consumers:

In any event of liability, the compensation may not exceed the total payments that have been, will be or would be received by the Owner from the User based on the contract over a period of 12 months, or the period of the duration of the Agreement, if shorter.

Limitation of liability

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which the User may have under the Competition and Consumer Act 2010 (Cth) or any similar State and Territory legislation and which cannot be excluded, restricted or modified (non-excludable right). To the fullest extent permitted by law, our liability to the User, including liability for a breach of a non-excludable right and liability which is not otherwise excluded under these Terms of Use, is limited, at the Owner’s sole discretion, to the re-performance of the services or the payment of the cost of having the services supplied again.

US USERS

Disclaimer of Warranties

Sajedhap.com is provided strictly on an “as is” and “as available” basis. Use of the Service is at Users’ own risk. To the maximum extent permitted by applicable law, the Owner expressly disclaims all conditions, representations, and warranties — whether express, implied, statutory or otherwise, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. No advice or information, whether oral or written, obtained by user from owner or through the Service will create any warranty not expressly stated herein.

Without limiting the foregoing, the Owner, its subsidiaries, affiliates, licensors, officers, directors, agents, co-branders, partners, suppliers and employees do not warrant that the content is accurate, reliable or correct; that the Service will meet Users’ requirements; that the Service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service; and
any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Service or User account or the information contained therein;
any errors, mistakes, or inaccuracies of content;
personal injury or property damage, of any nature whatsoever, resulting from User access to or use of the Service;
any unauthorized access to or use of the Owner’s secure servers and/or any and all personal information stored therein;
any interruption or cessation of transmission to or from the Service;
any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service;

This limitation of liability section shall apply to the fullest extent permitted by law in the applicable jurisdiction whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if company has been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore the above limitations or exclusions may not apply to User. The terms give User specific legal rights, and User may also have other rights which vary from jurisdiction to jurisdiction. The disclaimers, exclusions, and limitations of liability under the terms shall not apply to the extent prohibited by applicable law.

Indemnification

The User agrees to defend, indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees harmless from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from

User’s use of and access to the Service, including any data or content transmitted or received by User;
User’s violation of these terms, including, but not limited to, User’s breach of any of the representations and warranties set forth in these terms;
User’s violation of any third-party rights, including, but not limited to, any right of privacy or intellectual property rights;
User’s violation of any statutory law, rule, or regulation;
any content that is submitted from User’s account, including third party access with User’s unique username, password or other security measure, if applicable, including, but not limited to, misleading, false, or inaccurate information;
User’s wilful misconduct; or
statutory provision by User or its affiliates, officers, directors, agents, co-branders, partners, suppliers and employees to the extent allowed by applicable law.

COMMON PROVISIONS

NO WAIVER

The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.

Service interruption

To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates or any other changes, informing the Users appropriately.

Within the limits of law, the Owner may also decide to suspend or terminate the Service altogether. If the Service is terminated, the Owner will cooperate with Users to enable them to withdraw Personal Data or information in accordance with applicable law.

Additionally, the Service might not be available due to reasons outside the Owner’s reasonable control, such as “force majeure” (eg. labor actions, infrastructural breakdowns or blackouts etc).

SERVICE RESELLING
